Construction Drug Testing and OSHA: Understanding Post-Incident Testing

After an accident on a job site, many construction companies want to test everyone involved. That instinct makes sense, but OSHA rules require some care in how post-incident testing is handled.

OSHA’s anti-retaliation rule

OSHA’s recordkeeping rules prohibit employers from retaliating against employees for reporting work-related injuries or illnesses. OSHA has said that drug testing policies should not be used to discourage injury reporting.

In a 2018 memorandum, OSHA clarified that most workplace drug testing is permissible, including:

  • Random testing
  • Testing unrelated to injury reporting
  • Testing required by state workers’ compensation law or federal law, such as DOT rules
  • Post-incident testing to evaluate the root cause of an incident that harmed or could have harmed employees, as long as all employees whose conduct could have contributed are tested, not just the one who reported an injury

What to avoid

Policies that automatically test only the employee who reports an injury, regardless of whether impairment could have played a role, can create compliance risk. For example, testing someone for a bee sting or a repetitive strain injury may look like it’s intended to discourage reporting.

Building a compliant post-incident policy

  1. Define the triggers. Test after incidents where impairment could reasonably have contributed.
  2. Test everyone involved. Include all employees whose actions could have contributed, not only the injured person.
  3. Act quickly. Set timelines for testing after an incident.
  4. Document the reasons. Record why testing was conducted.
  5. Follow state law. Some states have specific rules tied to workers’ compensation and drug-free workplace programs.
  6. Keep DOT testing separate. CDL drivers must follow DOT post-accident rules.

Post-incident testing still matters

Handled correctly, post-incident testing helps you find the root cause of accidents, prevent future incidents, and support workers’ compensation and insurance processes.
