Post-Accident Drug Testing: Doing It Right

Accidents happen, even at the safest companies. When they do, a well-run post-accident testing program helps you determine whether drugs or alcohol played a role, protects your business from liability, and supports your safety culture.

Why post-accident testing matters

After a workplace accident or vehicle crash, questions come fast. Was the employee impaired? Could the accident have been prevented? Timely testing provides factual answers. It can also be important for insurance claims and workers’ compensation, depending on your state’s laws.

Timing is critical

Drugs and alcohol leave the body over time, so delays can make results less meaningful. For DOT-regulated employers, post-accident alcohol tests should be done within two hours when possible and no later than eight hours, and drug tests within 32 hours. Non-DOT employers should set equally prompt timelines in their written policy.

DOT post-accident criteria

For FMCSA-regulated drivers, whether a post-accident test is required depends on the facts. Testing is generally required after a crash involving a fatality, and after crashes involving an injury treated away from the scene or a vehicle towed away when the driver receives a citation. Employers need to know these criteria before an accident occurs.

Non-DOT employers and OSHA

Private employers may set their own post-accident rules, but they should be careful. OSHA has made clear that drug testing should not be used to discourage employees from reporting injuries. Testing is generally appropriate when there is a reasonable possibility that drug use contributed to the incident, or when testing is required by state or federal law. Blanket “test everyone who reports an injury” policies can create risk.

Build a post-accident checklist

  1. Ensure everyone’s safety and get medical care first.
  2. Determine whether the incident meets your testing criteria.
  3. Arrange transportation to a collection site.
  4. Document the time of the accident and the time of testing.
  5. Record reasons if testing could not be completed in time.
