Reasonable Suspicion Testing: Training Supervisors to Act

A supervisor notices an employee slurring words, stumbling near machinery, or smelling of alcohol. What happens next matters a great deal. Reasonable suspicion testing gives employers a structured way to respond, but only if supervisors know how to use it.

What is reasonable suspicion?

Reasonable suspicion testing happens when a trained supervisor observes specific, current, and describable signs that an employee may be under the influence. It must be based on facts, not rumors, hunches, or personal dislike.

Examples of observations that may support a test include:

  • Slurred speech or unusual speech patterns
  • Unsteady walking or poor coordination
  • Odor of alcohol or marijuana
  • Bloodshot or glassy eyes, dilated or pinpoint pupils
  • Unusual behavior, such as agitation, confusion, or drowsiness on the job
  • Direct observation of use or possession

Why training is essential

Untrained supervisors tend to either avoid confrontation or act without enough documentation. Both create risk. For DOT-regulated employers, supervisor training is required: supervisors who make reasonable suspicion decisions must complete training on the signs of drug and alcohol use. For non-DOT employers, training is a best practice that makes decisions more consistent and defensible.

A simple response process

  1. Observe and document exactly what you see, hear, and smell, with times and details.
  2. Get a second opinion from another trained supervisor when possible.
  3. Remove the employee from safety-sensitive duties right away.
  4. Arrange transportation. Never let a possibly impaired employee drive to the collection site.
  5. Send for testing promptly, following your written policy.
  6. Keep records confidential and complete your documentation.

Protecting everyone involved

A clear reasonable suspicion process protects coworkers and customers from harm, and it protects the employee from being judged on anything other than observed facts.
